Les modalités de cette exonération sont définies par décret. »III. – Compléter cet amendement par l’alinéa suivant :« IV. – La perte de recettes pour l’État est compensée à due concurrence par la création d’une taxe additionnelle à l’accise sur les tabacs prévue au chapitre IV du titre Ier du livre III du code des impositions sur les biens et services. »  Ce sous-amendement à l’amendement n°I-3630 vise à renforcer la proposition gouvernementale sur le tarif solidarité de la taxe sur les billets d’avion (TSBA), en l’alignant sur le barème de la classe économique du niveau allemand, et en renforçant le barème initial pour la classe business, qui concerne les voyageurs les plus aisés bénéficiant de services haut de gamme. Cette proposition permettra de dégager 2 milliards d’euros de recettes, soit 1 milliards de plus que la proposition initiale.Ainsi, tout en saluant l’initiative du gouvernement pour accroître la taxation du secteur aérien, nous estimons qu’il est nécessaire d’aller un peu plus loin en renforçant le principe du «pollueur-payeur» en ciblant davantage encore les voyageurs privilégiés, notamment ceux qui bénéficient de services haut de gamme.Une telle mesure permettrait non seulement de mieux répartir l’effort écologique et de responsabiliser les plus gros émetteurs, mais aussi de générer des recettes supplémentaires En outre, cette tarification, plus ambitieuse, est également plus pertinente d’un point de vue écologique, et fiscale. Le moment semble particulièrement propice puisque :- La France connaît une situation budgétaire critique qui appelle tous les secteurs, à commencer par les plus polluants à contribuer à la solidarité nationale.- Les pays qui hébergent les principaux aéroports internationaux en Europe (Allemagne, Pays-Bas, Royaume-Uni) prélèvent tous des montants de taxe sur les billets d’avion bien supérieurs à la France.<table style="width: 448.85pt; border-left: none; border-bottom: solid black 1.0pt; border-right: solid black 1.0pt; padding: .75pt .75pt .75pt .75pt;" width="138">71 €</td></tr></tbody></table> Ce sous- amendement, vise enfin à exonérer les territoires d’Outre-mer du tarif de solidarité afin de garantir la continuité territoriale dans un contexte d'urgence sociale et de lutte contre la vie chère.La fiscalité écologique n’est pas une fiscalité de rendement, elle doit s’accompagner d’une fiscalité incitative sur les modes de transport durables et d'un fléchage des recettes vers la transition écologique. C’est pourquoi nous suggérons, pour renforcer l’efficacité environnementale de la taxe et son acceptabilité, que les recettes dégagées soient affectées vers des dépenses en faveur de la transition écologique du secteur du transport. Le produit de la taxe pourrait ainsi abonder à hauteur de 800 millions d’euros affectés de la manière suivante :  - 500 millions d’euros fléchés pour l’agence de financement des infrastructures de transport de France (abrégé en AFIT France) afin de financer le développement du ferroviaire, notamment des trains de nuits. Dans son rapport sur les Trains d’Équilibre du Territoire (T.E.T.) publié en mai 2021, le Gouvernement montre la pertinence de constituer un parc de 600 voitures de trains de nuit pour un investissement de 1,5 milliard d’euros d’ici 2030. En décembre 2021, le ministère des Transports a promis la construction de 300 voitures de nuit pour 800 millions d’euros. Cet investissement est urgent, vu la pénurie de trains de nuit en Europe et l’état de vieillissement du parc. Nous proposons ici une ressource permettant de le financer.- 300 millions fléchés sur l’ADEME afin de financer la recherche et développement pour les carburants de synthèse afin d’atteindre l’objectif fixée par l’UE de 20 % de Carburant d’aviation durable (SAF) en 2035.
