ARTICLE PREMIER
Substituer aux alinéas 2 à 16 l’alinéa suivant :
« Art. L.O. 141‑1. – Un député qui exerce les fonctions de président ou de vice-président d’établissement public de coopération intercommunale à fiscalité propre ne peut exercer aucune fonction exécutive dans la commune au titre de laquelle il siège à l’établissement public de coopération intercommunale. ». ».
EXPOSÉ SOMMAIRE
Tout d’abord, cet amendement supprime l’interdiction d’exercer concomitamment un mandat national et un mandat exécutif local.
Ensuite, prenant en compte la montée en puissance de l’intercommunalité, il limite l’exercice de fonctions exécutives au sein des EPCI à fiscalité propre pour un parlementaire détenteur d’un mandat local. Ainsi, le parlementaire pourra ainsi être maire, ou adjoint au maire et membre conseil communautaire, ou bien être VP ou Président d’EPCI, et conseiller municipal.
